COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND INTENT TO REQUEST RELEASE OF FUNDS

This Notice shall satisfy the above-cited two separate but related procedural notification requirements.

REQUEST FOR RELEASE OF FUNDS

On or about November 1, 2012 the City of Grand Prairie will submit a request to the HUD Fort Worth Regional Office for the release of CDBG and HOME funds under Community development Block Grand Title 1 of the Community Development Act of 1974, as amended to undertake projects known as Rehabilitation  for the purpose of rehabilitation of single family low to moderate income households estimated rehab cost of $25,000.00 per project estimating 6 projects. Rehab cost may include such things as siding, HVAC, new windows, roof, plumbing, electrical upgrade. Total budget is $167,000. Emergency Repairs of up to $5,000.00 will be completed on emergency items that occur without warning, estimating 9 tiered projects. Emergency Repairs could be hot water heater replacement, water line repair, gas leak, HVAC repair, roof repair, ect. Total budget is $33,434. Sidewalk Repair/Replacement for repairing and replacing sidewalks in CDBG Low to Moderate areas at the following streets/blocks –  Highland Street, Census Tract 160.013 blocks, 806,810,814,818,822,826,830,834,901,902,905,906,910,914,918,926,930,934,938,942,946,950,954,1001,1002,1005,1006,1009,1010,1013,1014,1017,1018,1021,1022,1025,1026,1029,1030,1033,1034,1037,1038,1041,1042,1045,1046,1049,1050,1053,1054,1101,1102,1105,1106,1109,1110,1114,1117,1118,1121,1122,1125,1126,1129,1130,1133,1134,1137,1138 .Total budget of $100,000.Walnut Street, Census Tract 156.001 blocks 1501,1505,1509,1513,1517,1521,1525,1529,1533,1537,1625,1658,1662,1705,1709,1710,1713,1714,1717,1721,1725,1729,1730,1733,1801,1805,1806,1809,1813,and 1901. . Total budget of $65,000. Ruea Street, Census Tract 156.001 blocks 1706,1710,1714,1718,1722,1725,1726,1801,1805,1809,1813,1814,1817,1818,and 1822. Total Budget of $35,000.

HOME Investment Partnerships Program Title II of Cranston-Gonzalez National affordable Housing Act  of 1990, as amended, to undertake a project known as HOME reconstruct include homes that are deteriorated beyond a rehab (75% or more) they are removed and reconstructed at an estimated cost of $85,000. Estimating 3 houses. Total budget is $250,338. Partner with Habitat for Humanity building 2 homes, each one estimated cost of $32,500 with a total budget of $65,000. Work in conjunction with our 2 CHDO’s development lots and construction of one single family unit each at a cost of $27,824 each to be sold to low to moderate first time home buyers . Total budget is $55,648.

 

FINDING OF NO SIGNIFICANT IMPACT

The City of Grand Prairie has determined that the projects will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at  The City of Grand Prairie Housing and Neighborhood Services, 205 West Church, Grand Prairie, TX 75050 and may be examined or copied weekdays 8 A.M. to 5 P.M.

PUBLIC COMMENTS

Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Housing and Neighborhood Services Division of the City of Grand Prairie.  All comments received by October 31, 2012 will be considered by the City of Grand Prairie prior to authorizing submission of a request for release of funds.  Commenter’s should specify which part of this Notice they are addressing.

 

RELEASE OF FUNDS

The City of Grand Prairie certifies to HUD  that William A. Hills in his capacity as Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD  approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Grand Prairie to use Program funds.

 

OBJECTIONS TO RELEASE OF FUNDS

HUD  will consider objections to its release of funds and the City of Grand Prairie certification received by November 16, 2012 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the City of Grand Prairie approved by HUD ;  (b) the City of Grand Prairie has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD ; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD Fort Worth Regional Office  at 801 Cherry Street, Fort Worth, Texas 76113-2905.  Potential objectors should contact HUD to verify the actual last day of the objection period.
